Eksekusi Hak Tanggungan yaitu apabila debitor cidera janji maka obyek Hak Tanggungan dijual melalui pelelangan umum sesuai cara yang ditentukan dalam Pasal 6 UUHT dan pemegang Hak Tanggungan berhak
mengambil seluruh atau sebagian dari hasilnya untuk pelunasan piutangnya, dengan hak mendahului daripada kreditor-kreditor lain.
Eksekusi Hak Tanggungan diatur dalam Pasal 20 UUHT yang telah menentukan bahwa jika debitor wanprestasi, maka : berdasarkan hak yang ada pada pemegang Hak Tanggungan pertama yaitu janji untuk menjual objek Hak Tanggungan atas kekuasaan sendiri melalui pelelangan umum atau atas kesepakatan pemberi dan pemegang Hak
Tanggungan dapat dijual dibawah tangan; berdasarkan irah-irah yang terdapat dalam sertifikat Hak Tanggungan
mempunyai kekuatan eksekutorial yang sama dengan keputusan hakim yang telah mempunyai kekuatan hukum yang tetap.
Ketentuan ayat ini merupakan perwujudan dari kemudahan yang disediakan oleh undang-undang ini bagi para kreditur pemegang Hak Tanggungan dalam hal harus dilakukan eksekusi. Dan dalam pelatihan ini akan dibahas lebih detail terkait dengan tata cara dalam pelaksanaan eksekusi hak tanggungan.
